ARTICLE - The Model Procurement Code Revision Project: Revising Article 12 for a Procurement-Specific Ethics Framework

The Model Procurement Code Revision Project's Article 12 Drafting Committee has been reworking the Code's ethics framework for the first time since 1979, with a "Tiger Team" now harmonizing the article before it advances to full committee approval and public comment. The revision reframes Article 12 as a focused procurement ethics overlay rather than a general ethics code, deferring to existing ethics law where it already applies and targeting risks unique to procurement, such as kickbacks, contingent-fee influence peddling, and misuse of confidential information. Key changes include a new "Procurement Participant" concept to capture consultants and others who influence procurement decisions, sharpened conflict-of-interest and financial-interest rules, new gift and vendor-endorsement provisions, and a "cone of silence" channeling solicitation communications through the procurement officer. Some provisions are being removed or relocated to other articles, while a few issues, notably post-employment restrictions in § 12-208, remain unresolved.
